Artigly, headquartered in Seattle, Washington, operates a global marketplace connecting artists and shoppers from around the world on www.artigly.com (the “Platform”). This Return Policy outlines the process for returning items purchased on the Platform, ensuring fairness for all users. For transactions involving Washington State residents, we comply with Washington’s Consumer Protection Act (RCW 19.86). International artists and shoppers must adhere to their local consumer protection laws.
1. General Return Guidelines
Eligibility: Returns are accepted only for items that are damaged, defective, or significantly misrepresented in the artist’s listing (e.g., inaccurate description or images).
Non-Returnable Items: Due to the unique, handcrafted nature of items on Artigly, non-damaged or non-misrepresented items are not eligible for return unless the artist specifies otherwise in their listing.
Timeframe: Returns must be initiated within 14 days of delivery to the shopper, unless local laws require a longer period.
2. Shopper Responsibilities
Initiating a Return:
Contact the artist directly via the Platform’s messaging system within 14 days of receiving the item to report damage, defects, or misrepresentation.
Provide evidence (e.g., photos of damage or proof of misrepresentation) to support your return request.
Return Shipping:
Shoppers are responsible for return shipping costs unless the item was damaged or misrepresented due to the artist’s error, or unless local laws require otherwise.
Use a trackable shipping method and provide the artist with the tracking information.
Refund Process:
Once the artist receives and verifies the returned item, a refund will be issued to the original payment method within 7 days, unless local laws specify a different timeframe.
Refunds include the item’s purchase price (excluding original shipping costs) and any applicable taxes, such as Washington State sales tax (RCW 82.08) for deliveries within Washington.
3. Artist Responsibilities
Accepting Returns:
Artists must accept returns for damaged, defective, or misrepresented items within 14 days of delivery, per RCW 19.86 for Washington-based transactions and applicable local consumer protection laws for international transactions.
Promptly review shopper-provided evidence and communicate via the Platform’s messaging system.
Refund Processing:
Issue refunds within 7 days of receiving and verifying the returned item, unless local laws require a different timeframe.
Refunds must cover the item’s purchase price and applicable taxes, excluding original shipping costs unless the artist agrees otherwise or local laws mandate inclusion.
Shipping Costs:
Artists must cover return shipping costs if the return is due to damage or misrepresentation caused by their error, unless local laws state otherwise.
Dispute Mediation:
Artists must cooperate with Artigly to resolve return disputes. Contact support@artigly.com for assistance.
4. Artigly’s Role
Mediation: Artigly will mediate return disputes if the shopper and artist cannot reach an agreement within 7 days of the return request. For Washington-based transactions, mediation aligns with RCW 19.86. International disputes will be considered in accordance with applicable local laws.
Dispute Resolution: Unresolved disputes may be escalated to mediation in King County, Washington, for Artigly’s operations, or in accordance with applicable local laws for international users.
Platform Fees: Artigly’s 20% commission on the original sale is non-refundable, as it covers Platform services. Refunds apply only to the artist’s portion of the sale price (80%) and applicable taxes.
5. International Returns
Artists and shoppers from outside the United States must comply with their local consumer protection laws and international shipping regulations, including customs requirements for returns.
