Welcome to Artigly, a global online marketplace connecting independent artists and shoppers worldwide through www.artigly.com (the “Platform”). Artigly facilitates transactions between artists and shoppers but does not act as the seller of goods. These Terms and Conditions govern your use of the Platform, whether you are an artist or a shopper. By using the Platform, you agree to these terms. If you disagree, please do not use the Platform. Artigly is headquartered in Seattle, Washington, and complies with Washington State laws, including the Consumer Protection Act (RCW 19.86) and business licensing requirements (RCW 19.02). Artists and shoppers are responsible for complying with the laws of their local jurisdictions.

1. General Terms

Eligibility: Users must be 18 or older and reside in a region where Artigly operates.
Account Responsibility: You are responsible for maintaining the confidentiality of your account and password. Please notify us immediately of any unauthorized use at support@artigly.com.
Prohibited Conduct: Users are prohibited from engaging in illegal activities, posting harmful or misleading content, or violating intellectual property rights on the Platform.

2. Terms for Artists

Role as Independent Sellers:

Artists are independent sellers, not employees or agents of Artigly. You are solely responsible for your products, sales, and compliance with all applicable local, state, and international laws.
Business Licensing: You are responsible for determining and complying with any business licensing requirements in your jurisdiction. For example, Washington-based artists may need a Washington State business license per RCW 19.02 (see www.dor.wa.gov for details). During onboarding, you must acknowledge that you understand your local licensing obligations, if any.

Product Listings:

You must provide accurate descriptions, images, and pricing for your work. All items must be original, handcrafted, and owned by you. AI-generated art using sourced content without legal rights is prohibited.

Commission:

Artigly retains a 20% commission on all sales unless otherwise agreed. You receive 80% of the sale price, paid within 30 days of a completed transaction via the Platform’s payment system.

Copyright:

You retain the copyright of your work, as per your local laws, and, for Washington-based artists, RCW 43.46. By listing on the Platform, you grant Artigly a non-exclusive, worldwide license to display and promote your work.

Taxes:

You are solely responsible for determining, collecting, and remitting taxes as required by your local laws, including Washington State sales tax for sales to Washington residents per RCW 82.08 (see www.dor.wa.gov). Artigly provides sales reports to assist with your tax obligations.

Shipping:

You are responsible for shipping costs and ensuring timely delivery to global customers. Please provide tracking information within three business days of order confirmation. You must comply with international shipping and customs regulations.

Returns:

You must accept returns for damaged, defective, or misrepresented items within 14 days of delivery, per RCW 19.86 for Washington-based transactions and applicable local laws elsewhere. Refunds must be processed within 7 days of receiving returned items, covering the item price and applicable taxes, excluding shipping costs, unless the return is due to your error.
Indemnification: You agree to indemnify and hold Artigly harmless from any claims, losses, or liabilities arising from your failure to comply with local licensing, tax, or other legal requirements.

3. Terms for Shoppers

Purchases:

All sales are final, except for items that are damaged, defective, or misrepresented. Review artist listings carefully before purchasing.

Payments:

Payments are processed securely via Artigly’s payment provider. You are responsible for applicable taxes, including Washington State sales tax (RCW 82.08) for deliveries in Washington.

Returns and Refunds:

You may return damaged, defective, or misrepresented items within 14 days of receipt, subject to the artist’s return policy and local laws (e.g., EU Consumer Rights Directive). Contact the artist via the Platform to arrange returns. Artigly will mediate disputes if needed.

Dispute Resolution:

For unresolved disputes, contact support@artigly.com. Disputes involving Artigly may be escalated to mediation in King County, Washington, under RCW 19.86, or in accordance with applicable local laws for international users.

4. Intellectual Property

All content on the Platform, including artist work, is protected by copyright law (RCW 43.46 for Washington-based artists and applicable international laws). Shoppers may not reproduce, distribute, or modify purchased items without the artist’s permission.
Artigly will remove listings infringing on copyrights upon verified notification.

5. Privacy

Artigly collects and processes personal data per our Privacy Policy (artigly.com/privacy-policy), compliant with Washington’s Consumer Privacy Act (RCW 19.375) for Washington residents and applicable local laws for international users.

6. Liability

Artigly is not liable for disputes between artists and shoppers, except for facilitating communication and mediation. We are not responsible for the quality, safety, or legality of listed items.
You agree to indemnify Artigly against claims arising from your use of the Platform or your failure to comply with applicable laws.

7. Termination

Artigly may suspend or terminate accounts for violations of these terms, including non-compliance with applicable laws or fraudulent activity.
You may terminate your account by contacting support@artigly.com.

8. Governing Law

These terms are governed by Washington State law for Artigly’s operations. Any legal action involving Artigly will be filed in King County, Washington, per RCW 4.12.020. Artists and shoppers are also subject to the laws of their local jurisdictions.

9. Force Majeure

Artigly is not liable for delays or failures to perform due to unforeseen events beyond our control, including changes in state or international regulations.
